Terms for using DNY Mobile.

These terms govern the use of the DNY Mobile business communication platform, dashboard, API, webhook, SMS, WhatsApp and related services.

1. Acceptance of terms

By creating an account, accessing the dashboard, using the API or using any DNY Mobile service, you confirm that you have read, understood and agreed to these terms. If you use the service for an organization, you confirm that you have authority to bind that organization.

2. Services

DNY Mobile provides a platform for sending and receiving business communication, including SMS, WhatsApp, OTP, notifications, campaigns, Sender ID, dashboard, API, webhook, delivery reports and related support services. Features, operator networks, prices, usage limits and support may vary by country, destination, service type and package.

Services depend on operator networks and third-party providers. Therefore, DNY Mobile does not guarantee that every message will always be delivered, received or delivered without delay.

3. Permitted and prohibited use

You must use the service lawfully, responsibly and in accordance with applicable law, operator rules and channel provider policies. You must not use the service for:

  • spam, phishing, fraud, impersonation, malware or social engineering;
  • threats, extortion, harassment, hate speech, pornography, child exploitation or violence;
  • illegal activity, illegal gambling, prohibited goods or intellectual property infringement;
  • evading operator filters, sending limits, Sender ID verification or security mechanisms;
  • collecting or using personal data without a lawful basis, consent or proper notice; or
  • sending repeated or bulk messages that recipients did not request.

4. Consent and messaging rules

You are responsible for obtaining recipient consent before sending promotional or repeated messages, keeping proof of consent, clearly identifying the sender and providing an easy opt-out method. If a recipient opts out, you must stop promotional messages unless new consent has been obtained.

You are fully responsible for message content, recipient lists, Sender ID, templates, links, sending frequency and use of the service. DNY Mobile may reject, hold or block messages suspected of violating law, these terms or operator policies.

5. Account and security

Registration information must be accurate and kept up to date. You are responsible for protecting your password, API key, token, webhook credentials and account access. Contact DNY Mobile immediately if you become aware of unauthorized access. Activity performed through your account may be treated as your activity until the access is secured.

6. Balance, fees and payment

Service fees, balance, expiry, usage limits and refund terms follow the package or offer applicable at the time of the transaction. Fees may be based on messages, channel, destination, Sender ID, features or third-party services. You must ensure that your balance or payment method is sufficient before using the service.

7. Data, reports and backup

You remain responsible for data, contacts, message content and materials entered into the service. You grant DNY Mobile permission to process that data as needed to provide, secure, monitor and improve the service.

To maintain system performance, data in the delivery reports table may be cleaned periodically. By default, report data older than three months may be deleted at the beginning of each month. Before deletion, the system will create a CSV backup of the reports to be deleted and store it in the application’s internal storage.

That backup is an operational mechanism, not a permanent archive or an unlimited recovery guarantee. You remain responsible for exporting and independently retaining important data. DNY Mobile does not guarantee that a backup can be restored in every situation, including device failure, corruption, attack or events beyond reasonable control.

8. Suspension and termination

DNY Mobile may limit, suspend or terminate access in the event of a breach, fraud or spam risk, legal order, overdue payment, security threat or use that may harm other users, operators or the service. Where possible, DNY Mobile will provide notice, but may act immediately to prevent harm or violation.

9. Responsibility and limitations

You are responsible for use of the service and third-party claims arising from your content, recipient lists or activity. To the extent permitted by law, the service is provided as is and DNY Mobile is not responsible for lost profits, lost data, delays, operator network failures or indirect losses.

10. Changes to these terms

DNY Mobile may update these terms from time to time. The latest version will be published on this page with an updated date. Continued use of the service after changes take effect means that you accept the updated terms.
